If you suffer a work injury, your employer bears liability for damages without regard to fault. You must receive at least one third of your claim, and this even in cases where it is shown that you share the blame for the occurrence of the injury. For this reduction to one-third your employer must, however, prove this shared blame. As an employee you have no need to fear that your employer will not issue payment for your claims. Your employer will have liability insurance for damages caused to employees by work injuries—they are legally required to have it.
The compensation process should in theory go smoothly. However, we have over twenty years of experience with cases where employees’ claims were not settled to their satisfaction. There are two kinds of disputes here—on the legal basis for the claim and on the amount of the claim. Claims are often assessed and evaluated by employers as applying for incorrect, typically lower, amounts.
We will advise you against settling for only the compensation amount that the insurer offers you. This insurer will either be Česká pojišťovna, a.s. or Kooperativa pojišťovna, a.s. Do not fear a court dispute with your employer. They have to understand your demand for complete compensation. Unfortunately no-one will offer you compensation if your claim is not properly filed and presented in the courts. Do not wait to file your claim. Claims have statutes of limitations.

How we work:
